RLC's Position:
The RLC filed an amicus brief in support of the employer’s petition for certiorari to the U.S. Supreme Court. The brief explains the importance of analyzing questions of commonality before a class is certified. If left unchanged, the Ninth Circuit’s decision would allow meritless and improper classes to be certified and will prevent retailers who are faced with class actions from raising defenses to individual claims.
