Questions Presented:
I. Whether the U.S. Equal Employment Opportunity Commission's (EEOC) persistent failure and refusal to thoroughly investigate and conciliate class-based claims of Title VII discrimination prior to suit satisfies its statutory obligations and is consistent with this Court's Title VII jurisprudence.
II. Whether Title VII permits the EEOC to bring a class-based, patterns-or-practice discrimination claim under Section 706, rather than Section 707 thereby positional itself to collect substantial compensatory and punitive damages on behalf of individual class members without first having to prove individual harm.
RLC's Position:
The RLC filed a brief asking the U.S. Supreme Court to grant certiorari to clarify the extent of the Equal Employment Opportunity Commission's Title VII enforcement authority and pre-suit activities when bringing a pattern-or-practice discrimination claim.
Case Outcome:
The Court denied the employer's petition for certiorari.
