Issue on Appeal: What evidence of sale is required to apply the 15 year statute of repose in products liability actions.
RLC’s Position: The Texas Supreme Court should recognize that a "sale" occurs at time of release and apply the statute of repose at that point, regardless of future payment terms. Additionally, evidence of the sale occuring more than 15 years prior should trigger the statute of repose even if the exact date of the sale is not available.
