RLC's Position:
The RLC joined others in filing a brief asking the U.S. Supreme Court to grant review of and reverse the California Supreme Court's decision that pre-arbitration proceedings waivers can be considered when assessing the unconscionability of arbitration agreements. The California Supreme Court’s decision squarely conflicts with U.S. Supreme Court precedent and federal policy favoring the enforcement of arbitration agreements.

Case Outcome: 
The Court denied the petition for certiorari.
