RLC's Position:
The RLC asked both the District Court of South Dakota and the Eighth Circuit Court to dismiss TCF Bank's challenge to the constitutionality of the Durbin Amendment - a key piece of legislation that limits fees that can be charged on debit card transactions.
Case Outcome:
The District Court of South Dakota denied both the motion for preliminary injunction and the motion to dismiss the Complaint. The Court also decided not to rule on dismissal of the OOC for lack of jurisdiction. The U.S. Court of Appeals for the Eighth Circuit affirmed the judgment of the district court.
