Issue on Appeal:  Whether the FAA preempts state laws allowing agencies to pursue individualized damages arising from claims subject to binding arbitration agreements.

RLC’s Position: The RLC’s brief describes how state-level enforcement actions are acting as the latest vehicle for circumventing the FAA’s protections for individual arbitration. The brief also highlights the concerning nature of allowing state governments to rely on private plaintiff class action lawyers to find and file aggregated enforcement actions in court when those same claims are subject to binding individual arbitration when brought by the allegedly harmed party.
